g) fails to pay any sum due to the Purchaser hereunder (being a sum which is in excess of the amount that the Purchaser at the time the relevant payment becomes due and payable is able to drawdown under the Bonds held by the Purchaser at such time, and which is not reasonably in dispute) and such failure is continuing for forty two (42) days following notice of failure to the Contractor;
(h) has attainment of the limit of liability on penalties in accordance with clause 21.;
(i) has the existence of a defect that is irremovable after 180 (one hundred and eighty) days of grace period given by the Purchaser to the Contractor to correct or remedy that defect:
(j) if the Contractor was rejected/wasn’t approved by the Owner;
(k) in other cases directly provided for under the Contract;
