16.3 Both the Contractor and its sub-contractors shall, ensure that all
policies required under Clause 16.1 wherever possible shall include
the Council as co-insured for its separate interest and that the
policies are endorsed to prevent any exercise of rights of
subrogation against the Council, its other contractors and its or
their staff. The Council shall be entitled to the proceeds of such
insurance policies to the extent of the Contractor‟s liability in
respect of the risks covered by such insurance.
