24, 25, 30, 31 December 2015; 1, 2 January 2016, from 6 to 14 February 2016; 29, 30 April 2016; 1, 2 May 2016; 1, 2, 3 September 2016; 24, 25, 30, 31 December 2016. Surcharge at 600.000VND/room/night will be applied for these peak days and combined with the following:
• No room for tour guide
• Non-refundable and full payment is required at the time of booking.

SEASONS:
• Low season: 1st November 2015 to 30th April 2016; 1st September 2016 to 31st December 2016
• High Season: from 1st May 2016 to 31st August 2016.

• Every 10 paid room nights will get 1 room nights for tour guide. It will be valid during period of booking.
• Every 12 paid room nights will get 1FOC Superior room night.
• FOC room nights can be accumulated and cannot be deducted from outstanding payment.
• FOC room nights cannot be used during peak days and must be used by the end of 2016.
• FOC room nights are subject to availability.

RATES BENEFITS:
• Daily buffet breakfast for maximum two (2) persons per room per night at the hotel restaurant
• Complimentary high speed internet access in the guest room
• Complimentary access to the Hotel Gym, Children play room and Pool
• Daily complimentary 2 bottles of mineral water
• Extra bed fee is 500.000VND/ night, including breakfast for 1 more person
• Maximum of two (02) children under the age of six (6) years can sleep with parents in the existing bed with no additional charge.
• Surcharge for child from 6 – 11 years old sleeping with parents (No Extra Bed) is 125.000 VND/ night including breakfast
• Surcharge for child from 12 years old and above sleeping with parents (No Extra Bed) is 200.000 VND/night including breakfast
PACKAGE TERMS
• All rates are valid till 31st December 2016.
• All rates are in VND.
• All rates are non-commissionable.
• Rates are inclusive of 10% government tax and 5% service charge.
• Room rates are applicable on The Operator's account only. Should the guest be paying on own account, walk-in rates will be applied.
• The check-in time is after 1400 hours and the check-out time is before 1200 hours.
• Room requiring check-in prior to 1400 hours will require reserving the room one (1) day earlier to guarantee early check-in. It will be charged at 100% of the daily contracted room rate and should be requested at time of reservation.
• Late Check-out till 6:00 pm are available, subject to availability at 50% of the daily contracted room rate. After 6:00 pm the full contracted room rate will be applied.
• Early Departures: Once check–in formalities have been completed, should a guest depart earlier than the scheduled check out date, full length stay room charges will be applied regardless the situation.
• All rates are subject to change without prior notice.
• Should unforeseen matters happens, the management has the right to refuse booking without any reason given.

BOOKING PROCEDURE
Written confirmations from the Operators are required 07 days prior to guest/s check-in. Walk-in rates will be applied and chargeable to the guest and payment made before check out in absence of written confirmation.

SETTLEMENT OF ACCOUNT
If credit facility has not been established with the hotel, full payment is required before guest’s check-in.
Payment can be settled by cash with official letter from The Operator.

Payment is by means of a Bank Guarantee, Floating Deposit, Telegraphic Transfer or such other security acceptable to The Hotel. The amount and all other details of this must be discussed and agreed between the Operator and The Hotel.

Should prepayment not be received for the bookings 07 days prior, The Hotel reserves the right to release all bookings not guaranteed by deposit. The Operator will be liable for all arrangements and costs that are necessary to inform and accommodate its guests. In such instances, The Hotel will have no responsibility and / or liability whatsoever in this situation and to accommodate the guest/s that have booked via The Operator.

CREDIT
The Hotel’s manager will provide credit terms under a separate cover. Failure to comply with credit terms may result in suspension of The Hotel’s obligations of this agreement. The Hotel will have no responsibility and / or liability whatsoever in this situation to the operator and/or its guest/s.

If credit facilities have been established with The Hotel, all invoices including master account and cancellation / no show charges are due and payable accordingly to credit terms. The Hotel reserves the right to take any appropriate action in respect of over due accounts. For accounts not paid accordingly to credit terms, The Hotel will levy interest at 1.5% per month of the total outstanding account. In the event of a disputed charges, the undisputed amount due must be paid accordingly to credit terms. The Hotel reserves the right to demand full payment for all outstanding accounts under this agreement. Should such payment not be made to The Hotel when requested, The Hotel at its discretion may cancel the credit privileges.

CANCELLATION AND NO-SHOW
The Hotel will charge for cancellations as follows:
• For Cancellations received by the hotel within 07 days prior to 3 days before arrival date, one (1) night room charge will be applied as cancellation fee for every room cancelled.
• For Cancellations received by the hotel 03 days prior to arrival date – 100% room charge will be applied as cancellation fee for every room cancelled.
• Any cancellations and amendments must be informed to The Hotel in writing. The acknowledgement of these cancellations and amendments by The Hotel must be approved and recorded.
• Penalty charge of full payment for no-show is applicable for entire booking. In case The Operator refused to make payment, The Hotel has the right to pursue with any legal necessary means and revoke all privileges and benefits from The Operator.
• Organized meal in the hotel restaurant and/or the hotel banquet rooms: penalty fee for entire cancellation of meal is applicable for cancellation made within forty eight (48) hours prior to arrival.
• During business peak days, all cancellations will be subject to a 100% fee of booked nights (penalty will equal the total cost of all nights booked)

AMENDMENTS
The Hotel reserve the right to amend this contract without any prior notice given.

CONFIDENTIALITY
All information in this contract is confidential and both Parties may not be disclosed to the other for whatever reason or purposes without the written consent from The Hotel.

ADVERTISING IN THE INTERNET
These confidential rates offered to The Operator are not for use via the Internet for any form of direct selling. If your organization or company decides to promote Diamond Sea Hotel on the Internet, The Hotel must be notified in writing 30 days in advance seeking for the approval from The Hotel. In the case The Hotel has given written approval to The Operator, these contract rates be used on the internet, there must be a minimum mark up of 30% to the rates and the rates must be packaged with air tickets tours and/or sightseeing arrangements. This is to ensure the nightly accommodation rates are not revealed to the public. If this is not adhered to, The Hotel reserves the right to withdraw the rates from The Operator without any prior notice and revoke any and all benefits and privileges and in worst case scenario refuse to accommodate The Operator’s guest/s

TERMINATION
The Hotel shall have the absolute right at any time by giving notice in writing to The Operator to cancel this agreement forthwith including current and future reservations on the occurrence of any of the following events:
• Non-compliance with agreed trading terms.
• If The Operator based on these contracted rates, does not produce a minimum increase in paid room nights of 20% when compared at specific year over year periods.
• If The Operator enters into bankruptcy or liquidation whether compulsor
