Therefore, the validity of the contents of the Charter should be secured regardless of some difference of the wording in the Charter and the Investment License.
However, it is noted that Article 10 of the License 1995 states that if any content of Charter and Joint venture contract is contrary to the content of this Investment License and the laws of Vietnam, the content of this Investment License and the laws of Vietnam will prevail.
Therefore, if “ contradiction” is found between the content of Charter and Joint venture contract and the content of this Investment License, it could be argued that the content of Investment License prevails based on the wording of the Investment License , although there is no regulation in the law and regulations which explicitly regulate this issue.
