Cash payment regulation in Vietnam26/03/2014Newscash payment, VietnamAdmin8Aiming to manage cash payment in the Vietnam territory, basing upon Law on Vietnam State Bank dated June 16, 2010 and Law on Credit Institutions dated June 16, 2010 and proposal from the Governor of Vietnam State Bank, on December 31, 2013 the Vietnam Government issued Decree No. 222/2013/ND-CP on cash payment.cash restrictionThe objects of the Decree: State Bank of Vietnam (hereinafter referred to as the State Bank), credit institutions and branches of foreign banks, the State Treasury and the organizations, individuals involved in cash payment.Accordingly, the Decree provides cases which are not allowed to make cash payment as following:-The organizations using state budget funds and state capital, except in cases of cash payment under the provisions of the Ministry of Finance or the State Bank. (Organizations using state budget funds are budgeted units, the units use state budget, agencies and organizations funded by state budget, investors, project management units funded by the state budget; Organizations using state capital are organizations using credit capital guaranteed by the State, investment and development credit capital of the state, and other investment capital of the State). -Securities transaction on the Stock Exchanges; securities transaction registered at the Center of Securities Depository not through the transaction system of the Stock Exchanges.-Transactions of purchase, sale, contribute and transfer capital to enterprise.
-Enterprises are not credit institutions upon acts of borrowing and lending each other.
Regarding disbursement of loans capital, the credit institutions and branches of foreign banks release disbursement to clients in cash under regulations of the State Bank. The Credit institutions and branches of foreign banks deal with customers on cash withdrawal plan and notification of the customers before withdrawing large amounts of cash. The units deal with the State Treasury wishing to withdraw cash at the State Treasury shall register in accordance with the regulations of the Ministry of Finance.
The State Bank defines cash services fees for customers. Credit institutions and branches of foreign banks set cash services fees for their customers and publicly posted as prescribed by law.
The Decree takes effect on March 01, 2014 and replaces the Decree No. 161/2006/ND-CP dated December 28, 2006 on cash payment.
