CIRCULAR

REGULATIONS ON MANAGEMENT OF E-COMMERCE WEBSITES

Pursuant to the Government’s Decree No. 95/2012/NĐ-CP dated November 12, 2012 defining functions, duties, authorities and organizational structures of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 52/2013/NĐ-CP dated May 16, 2013 on e-commerce;

Pursuant to the Government’s Decree No.59/2006/NĐ-CP dated June 12, 2013 regulating in detail the law on goods and services banned, restricted from business, and subject to conditional business;

The Minister of Industry and Trade has promulgated the Circular regulating the management of e-commerce websites.

Chapter I

GENERAL PROVISIONS

Article 1. Governing scope

1. This Circular regulates in detail and guides the implementation of some articles of the Government’s Decree No. 52/2013/NĐ-CP dated May 16, 2013 on e-commerce (hereinafter referred to as the Decree No. 52/2013/NĐ-CP) regulating business activities on e-commerce websites, sequence and procedures of notifying and registering e-commerce websites, e-commerce websites rating activities and publishing information on e-commerce management portal.

2. This Circular does not apply to websites in finance, banking, credit, insurance; websites in purchase and exchange of money, gold, foreign exchange and other payment means; websites providing online games, betting or games of chance. Such websites are subject to jurisdiction of corresponding sector management.

Article 2. Regulated entities

This Circular applies to:

1. Traders, organizations, individuals selling goods on their own websites (hereinafter referred to as owners of online shopping websites).

2. Traders, organizations that own websites for providing e-commerce services (hereinafter referred to as owners of e-commerce service websites).

3. Sellers on e-commerce service websites.

4. Traders, organizations specialized in rating e-commerce websites

5. Organizations, individuals carrying out online reflection on e-commerce management portal.

Article 3. Trading goods and services subject to restrictions and conditional business on e-commerce websites;

1. Traders, organizations, and individuals are not permitted to use e-commerce websites to trade in goods and services subject to restrictions as follows:

a) Shotguns and bullets, sporting weapons, combat gear;

b) Cigarettes, cigars and other finished products of tobacco.

c) Alcoholic drinks;

d) Precious and rare wildlife and plants including live species and their processed parts;

dd) Other goods restricted from trading under the law.

2. Traders that own websites for the sale of goods and services subject to conditional business should post on their websites information of the Certificate of fulfillment of business conditions granted for businesses that have met conditions for trading such goods and services.

Phạm vi quản lý1. thông tư này quy định chi tiết và hướng dẫn thi hành một số điều của chính phủ nghị định số 52/2013/NĐ-CP ngày 16 tháng 5 năm 2013 về thương mại điện tử (sau đây gọi tắt là nghị định số 52/2013/NĐ-CP) quy định các hoạt động kinh doanh trên trang web thương mại điện tử, trình tự và thủ tục đăng ký và thông báo cho các trang web thương mại điện tử, thương mại điện tử trang web đánh giá hoạt động xuất bản thông tin trên cổng quản lý thương mại điện tử.2. thông tư này không áp dụng cho các trang web trong tài chính, ngân hàng, tín dụng, bảo hiểm; Các trang web trong mua và trao đổi tiền, vàng, ngoại hối và thanh toán khác có nghĩa là; Trang web cung cấp trò chơi trực tuyến, cược hoặc trò chơi của cơ hội. Các trang web phải tuân theo thẩm quyền của quản lý khu vực kinh tế tương ứng.Điều 2. Quy định thực thểThông tư này áp dụng cho:1. thương nhân, tổ chức, cá nhân bán hàng trên trang web riêng của họ (sau đây gọi tắt là chủ sở hữu của trang web mua sắm trực tuyến).2. thương nhân, tổ chức sở hữu các trang web cung cấp dịch vụ thương mại điện tử (sau đây gọi tắt là chủ sở hữu của thương mại điện tử dịch vụ trang web).3. người bán trên trang web dịch vụ thương mại điện tử.4. thương nhân, tổ chức chuyên về đánh giá trang web thương mại điện tử5. tổ chức, cá nhân thực hiện các phản ánh trực tuyến về thương mại điện tử quản lý cổng thông tin.Điều 3. Thương mại hàng hóa và dịch vụ tùy thuộc vào giới hạn và điều kiện kinh doanh trên các trang web thương mại điện tử;1. thương nhân, tổ chức và cá nhân không được phép sử dụng thương mại điện tử trang web để thương mại trong hàng hoá và dịch vụ tùy thuộc vào giới hạn như sau:a) loại súng và đạn, thể thao vũ khí, chống lại bánh;b) thuốc lá điếu, xì gà và khác đã hoàn thành các sản phẩm thuốc lá.c) nghiện rượu uống;d) quý giá và hiếm động vật hoang dã và thực vật bao gồm các loài sống và các bộ phận xử lý;dd) hàng hoá khác bị hạn chế từ kinh doanh theo pháp luật.2. thương nhân mà sở hữu trang web để bán hàng hoá và dịch vụ tùy thuộc vào điều kiện kinh doanh nên đăng bài trên trang web thông tin của họ của giấy chứng nhận hoàn thành điều kiện kinh doanh được cấp cho các doanh nghiệp đã đáp ứng các điều kiện cho các giao dịch như vậy hàng hoá và dịch vụ.
