• For mandatory sectoral standards,

• For mandatory sectoral standards, they shall be:

 Converted into national technical regulations before December 31, 2011 under Article 11.2.(a) , Decree No.127/2007/ND-CP;

 Amended and converted into national technical regulations before December 31, 2011 under Article Article 11.2.(b) , Decree No.127/2007/ND-CP; or

 Cancelled before September 30, 2008 under Article 11.2.(c) , Decree No.127/2007/ND-CP.

Thus, under these regulations, there shall be no sectoral standards from December 31, 2011. However, we have checked the three (03) sectoral standards (22 TCN 318 - 03, 22 TCN 316 - 03 and 22 TCN 317 - 03) in www.thuvienphapluat.vn and see that there is no document cancelling or replacing them. We also have called the related agencies to verify this but received different replies [e.g. the STAMEQ told us that these sectoral standards were still effective as there were no documents cancelling them; the VSQI (an agency of STAMEQ) told us that because there were no documents converting them into national standards, they automatically became ineffective]. The opinion of the STAMEQ is more convincing as it is in compliance with the common principle of legal practice in Vietnam (i.e. a legal document shall not cease to be effective unless otherwise provided in another legal document). However, in order to obtain a more reliable proof for your reference, we are still sending Official Letters to related agencies to ask for their official confirmation about the effectiveness of these sectoral standards. We will keep you posted accordingly when we receive their responses.

• Đối với các tiêu chuẩn ngành bắt buộc, thì được:  Chuyển Đổi thành quy chuẩn kỹ thuật quốc gia trước khi 31 tháng 12 năm 2011 theo Điều 11.2 (a), Nghị định số 127/2007 / NĐ-CP;.  Sửa đổi và chuyển đổi thành quy chuẩn kỹ thuật quốc gia trước ngày 31, 2011 theo Điều Điều 11.2 (b), Nghị định số 127/2007 / NĐ-CP. hoặc  hủy trước 30 tháng 9 năm 2008 theo Điều 11.2. (c), Nghị định số 127/2007 / NĐ-CP. Như vậy, theo các quy định, sẽ không có tiêu chuẩn ngành từ ngày 31 tháng 12 năm 2011. Tuy nhiên, chúng tôi đã kiểm tra ba (03) tiêu chuẩn ngành (22 TCN 318-03, 22 TCN 316-03 và 22 TCN 317-03) trong www.thuvienphapluat.vn và thấy rằng không có văn bản hủy bỏ hoặc thay thế chúng. Chúng tôi cũng kêu gọi các cơ quan có liên quan để xác minh điều này nhưng không nhận được trả lời khác nhau [ví dụ như Tổng cục TCĐLCL đã nói với chúng tôi rằng các tiêu chuẩn ngành vẫn còn hiệu quả vì không có văn bản hủy bỏ chúng; các VSQI (một cơ quan của Tổng cục TCĐLCL) nói với chúng tôi rằng vì không có văn bản chuyển đổi chúng thành các tiêu chuẩn quốc gia, họ sẽ tự động trở thành không hiệu quả]. Các ý kiến của Tổng cục TCĐLCL là thuyết phục hơn vì nó là phù hợp với các nguyên tắc chung của thực tiễn pháp lý ở Việt Nam (tức là một tài liệu pháp lý sẽ không còn hiệu lực thi trừ trường hợp quy định tại một văn bản khác).
