Tham had had got an advertisement for a share accommodation in the local newspaper from Mr Mien family.Accordingly. When Mr Mien was travelling with his family in January 2005, she took the opportunity to travel with him in the hope of finding or reuniting with her mother. Mr Mien had informed Ms Tham that their respective families may have been neighbours long ago in Vietnam. On arrival at the Airport on 8 January 2005, Tham merely saw Dang and greeted him and his family members. However, they all travelled in the same vehicle to the village in Soc Trang (because Mr Mien and Ms Tham happen to come from the same village).During the course of the journey to the village, Tham was introduced to Dang by Mr Mien. On that occasion they had little reason to talk much to each other.Ms Tham had to stay with Mr Mien’s family at the village. Dang was living only few blocks away, in the same village. On 13 January 2005,Tham’s old childhood friend, .................invited her to his engagement ceremony in the same village. Many co-villagers attended the ceremony including Mr Dang. They were sitting on the same table in the company of Mr Mien (Dan’s uncle), Mr Mien’s daughter-Thanh, as well as Mr Mien’s other relatives and friends in attendance.A mutual conversation started between Dang and Tham.Tham thought that Dang was a gentleman and decent. He was soft-spoken and appeared kind. She felt comfortable talking to him.Dang was attracted by Tham’s personality. He thought she is an outgoing and interesting personality. She also looked beautiful and caring in his eyes. They both discussed their resp[ective situations. Tham stated that she was visiting Vietnam on holiday. She also told Dang about her work in Australia. He in turn told her about his involvement in the family fishing business. They both felt comfortable in the company of each other. They both felt the need to go out together. They had the opportunity to visit many interesting places together including:• Visit to uncle Bay (uncle 7) where they did some fishing• Visit / sightseeing to the Port of “Cang O Kinh Ba”• The Market at Soc Trang• They went to Restaurants together on a few occasionsThey would both go out together alone and occasionally in the company of Dang’s uncle’s daughters.Few days later, Dang took Tham to his family (some of whom Tham already had occasion to meet).

Tham introduced Dang to Minh on that occasion.
Their relationship/friendship developed to such an extent that they both felt virtually inseparable from each other.
However, Tham had to return back to Australia, to resume at her workplace.
She was seen off at the Airport on 31 January 2005 by Dang and his family.
Post-Return to Australia
Upon returning to Australia, the couple kept in regular contact by way of phone.
Tham would generally call Dang at least twice a week and speak on average about 15 minutes on each occasion.
Occasionally, Dang would also initiate phone calls from Vietnam (via the Post Office)
On or about 26 March 2005, Tham telephoned Dang in the normal manner. Suddenly during this particular conversation, Dang became emotional on the phone and told Tham he does not want to lose her.
He told her that it could be good if they both consider committing to each other.
He asked Tham if she would become engaged to him.
Tham was very excited but was short of words though very happy.
She asked Dang to give some time to consider the proposal.
Accordingly, Tham took the time to prepare for a short trip to Queensland with her daughter, Jennifer (then about 7 months old).
She visited Queensland on or about 5 April 2005 to see both her father. This was also her opportunity to introduce Jennifer to her grandfather and her (Tham’s) step mother.
She had the opportunity to inform her father about Dang’s proposals.
Her father was very happy and supportive and gave his blessings to the engagement proposal.
On returning to Melbourne, around 15 April 2005, Tham telephoned Dang to indicate her acceptance of the engagement proposal.
Dang was very happy and he in turn, informed his parents in Vietnam. They also gave their support and blessings.
Accordingly, a mutual preparation began to celebrate the engagement of the couple.
