15 SEVERABILITY It is the desire and intent of the Company and the Receiving Party that the terms and conditions of this Agreement shall be enforced to the fullest extent permitted under applicable laws, and this Agreement shall be deemed to be an executed agreement enforceable and admissible for all purposes as may be under the terms of this Agreement. Accordingly, if any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, or becomes by operation of law invalid or unenforceable, then this Agreement shall be deemed amended to delete therefrom the portion that is adjudicated or which becomes by operation of law invalid or unenforceable, such deletion to apply only with respect to the operation of that term or condition and the remainder of this Agreement full force and effect.
16 INTERPRETATIONS The construction of the words and phrases in this document shall be interpreted that (A) reference to the Agreement means reference to this Agreement to include any other agreements, documents, term sheets, appendixes and contracts connected to the Authorized Purpose, and (B) the clause and paragraph headings in this Agreement are for ease of reference only and shall not be taken into account in the construction or interpretation of the clause or paragraph to which they refer. Words importing the singular meaning where the context so admits shall include the plural meaning and vice versa. Words of the masculine gender include the feminine and neuter genders and words denoting natural persons include corporations and firms and all such words shall be construed interchangeable in the manner. Words denoting an obligation on a party to do any act matter or thing include an obligation to procure that it be done and words placing a party under a restriction include an obligation not to permit infringement of the restriction.
17 CONFIDENTIAL PARTY LIST A list of Confidential Parties, as per Annex "List of Confidential Parties", shall be added upon and updated whenever the Company introduces such defined Confidential Party. The list shall be signed and declared unilaterally by the Company, fair, unbiased and evident showing as Confidential Parties and the Receiving Party may acknowledge the same. The said List of Confidential Parties shall be sent by e-mail to the Receiving Party after such defined declaration is updated by the Company.
18 ENTIRE AGREEMENT All signatories hereto acknowledge that they have read this Agreement soberly, have their rights to seek their legal representative to fully understand, and thereafter, agree to the terms and conditions contained in this Agreement, and as such affix their initial and/or signature herein unconditionally and without duress.
