Legal and Regulatory; Vietnamese Labor LawIn every business, included HSBC Vietnam and HSBC Holding Plc, understanding and obey the national and international labor law is not only the act of protecting the right of employment, but it’s represent for the respect of company to the law. HSBC Vietnam has operated in Vietnam for many years; because of HSBC is a registered company, there for HSBC needs to obey the Vietnamese Labor Law to ensure the quality of working environment, employment rights and the attitude of respect the Vietnamese Legislature. Back in cases, HSBC is offering the Retail Banker position of fresh-graduated students from the university, HSBC must obey the Vietnamese Labor law in term of ONLY recruiting the employing the personally who is over 18 years old (Vietnamese Labor Law, Article No.6, 1994). In order to fit with the required regulation form Vietnamese Government, HSBC has clearly stated in the Job Descriptions that every candidate must be from the age of 22 years old to 27 years old to get selected for the position of Retail Banker.In addition, the Vietnamese Labor Law has required every business in Vietnam territory to obey the regulation in term of working hours, according to Vietnamese Labor Law, 1994 Version, Article No.68, the standard working hours is not EXCEEDED 48 hours per week. That’s why HSBC obeys the Vietnamese Law by offering employment to work only from 35 – 44 hours per week, depend on the Department and particular job, the standard working hours of HSBC is started at 9am every morning and ended at 5pm every afternoon, which included 1 hour unpaid for lunch and taking the rest (HSBC Hand Book, 2014). Also, the Vietnamese Labor Law requires that the company doesn’t have right to force its employment to work continuously during 8 hours (According to the Labor Code, Article No.71, Vietnamese Labor Law 1994), the law also stated very clear that “In case the employees work continuously for eight hours, they have right to have AT LEAST A HAFT hour for rest”. Back to HSBC regulations, every day at work, the employment is allowed to have lunch and take some rests between 12:00 Am to 13:30 PM, this time is total up to 1 hour and 30 minutes, this is the evidence to shows that HSBC cares about its own employment and obeys the provided law by Vietnamese Government.
