In response to your questions regarding the Registry’s letter, we advise as follows. 1 The Registry’s letter is simply a standard procedure asking the applicant if they would like rather not to proceed with the publication of the request to record. For purposes of publication, all the fact of its publication and entry in the Register will be advertised. Therefore, in case there are any changes, alterations or amendments to the designated patent (the European Patent) based on which the HK Patent Application was filed, the applicant can withdraw the HK application before it is published. Unless you are aware that the designated patent will not be granted and the applicant is of the view that he does not want to proceed with the application to request to record, we do not see any advantage of filing such request because if the application were withdrawn, we cannot re-file the application since the priority period to extend the designated patent to Hong Kong has also expired. 2 There is no official fee for filing the request to withdraw. Our fee for writing to the Registry informing of such withdrawal is US$ 150.
