The conventional economic rationale for the protection of IPRs
is often framed in terms of Kenneth Arrow’s seminal work on the incomplete
appropriability of knowledge.6
IPRs can be understood as
second-best solutions to the problems created by the “quasi-public
good” nature of knowledge.7
To the extent that IPRs enhance appropriability,
they are expected to foster investment in research and
development (R&D) and knowledge creation.8
