Opportunistic Independence Third, following previous works on the French CC, we propose two ways to test whether the CC invalidates more laws when the polity is divided. To begin with, our set of independent variables includes a dummy variable, which accounts for the fact that the Senate’s majority is aligned with National Assembly’s majority ( senate ). Following the opportunistic independence theory, we expect this variable to have a negative coefficient, meaning that the censorship rate decreases when the polity is united (i.e. the
two Chambers support the government).
