Re: Termination of Contract on the purchase of 3,000 Phoenix Tulip seeds
Dear Mr. Daniel Grayson,
We are so disappointed that you refused our request for the refund of the contract price of USD 150,000. As mentioned in our previous email, 75% of the seeds are defective: 50% of those seeds could not bloom as expected and even 25% could not give any flowers at all! We believe your defective delivered seeds do not conform to the contract. For this reason, we hereby terminate the contract.
Moreover, we are determined to enforce our rights in arbitration at Vietnam International Arbitration Centre (VIAC) as agreed in the contract to claim for damages caused by your breach of contract.

Thưa ông Daniel Grayson,
Chúng tôi rất thất vọng khi bạn từ chối yêu cầu của chúng tôi cho việc hoàn trả giá hợp đồng là 150.000 USD. Như đã đề cập trong email trước của chúng tôi, 75% của các hạt này có khiếm khuyết: 50% của những hạt giống không thể nở hoa như mong đợi và thậm chí 25% không thể đưa ra bất cứ bông hoa nào cả! Chúng tôi tin rằng hạt giao khiếm khuyết của bạn không phù hợp với hợp đồng. Vì lý do này, chúng tôi xin chấm dứt hợp đồng.
Hơn nữa, chúng tôi quyết tâm thực thi các quyền của chúng tôi trong trọng tài tại Việt Nam Trọng tài Quốc tế Trung tâm (VIAC) theo thoả thuận trong hợp đồng để yêu cầu bồi thường thiệt hại do vi phạm hợp đồng của bạn.
