6.2 Obligations of the Landlord
The Landlord shall have the obligation to do the following:
6.2.1 provide the Tenant with accurate information about approved detailed planning, design of the Building and the Apartment;
6.2.2 ensure construction quality, architecture, technique and finished materials of the Building in accordance with current design and technical standards;
6.2.3 deliver the Apartment in accordance with the terms of this Agreement together with the floor plan where the Apartment is located and the architectural design related to the Apartment;
6.2.4 maintain the Apartment before delivering to the Tenant;
6.2.5 organise the first General meetings of the apartment owners to establish the Management Committee; perform the responsibilities of the Management Committee in case the Management Committee has not been established;
6.2.6 carry out warranty works over the Apartment within the Warranty Period pursuant to a written notice of the Tenant in accordance with the laws of Vietnam and the General Internal Rules;
6.2.7 pay penalty and compensate damages to the Tenant when breaching provisions in which the Landlord has to pay penalty and compensate in accordance with the provisions of this Agreement or the decisions of competent authority;
6.2.8 pay capital reserve 2% in accordance with the laws with respect to the Private Areas owned by the Landlord and transfer all Capital Reserve collected from the Tenant to the bank account and assign to the Management Committee; and
6.2.9 instruct and assist the Tenant to sign the services contract with water, sewerage, telecommunication and cable television supplier.
ARTICLE 7. TENANT’S DEFAULT
7.1 Without prejudice to other rights and obligations conferred on the Landlord under this Agreement and the laws of Vietnam, the Tenant shall has the responsibility to compensate the Landlord all damages arising out of any breach by the Tenant during the performance of this Agreement in accordance with the laws of Vietnam.
7.2 Without prejudice to the rights and obligations conferred on the Landlord under this Agreement and the laws of Vietnam, if the Tenant fails to pay or fully pay the Apartment Leasing Price or any other amount payable to the Landlord under this Agreement on its due date, the Tenant shall pay interest on the overdue amount calculated from the due date until the date of receipt of the overdue amount by the Landlord at the rate of Penalty Rate.

6.2 Nghĩa vụ của chủ cho thuê
Chủ cho thuê có nghĩa vụ phải làm như sau:
6.2.1 cung cấp cho thuê với các thông tin chính xác về quy hoạch chi tiết được duyệt, thiết kế của tòa nhà và căn hộ;
6.2.2 đảm bảo chất lượng xây dựng, kiến trúc, kỹ thuật và thành phẩm tài liệu của tòa nhà theo đúng thiết kế hiện hành và các tiêu chuẩn kỹ thuật;
6.2.3 cung cấp các căn hộ phù hợp với các điều khoản của Hiệp định này cùng với các kế hoạch sàn nhà, nơi các căn hộ có vị trí và thiết kế kiến trúc liên quan đến căn hộ;
6.2.4 duy trì các căn hộ trước khi cung cấp cho người thuê;
6.2.5 Tổ chức các cuộc họp chung đầu tiên của các chủ sở hữu căn hộ để thành lập Ban Quản lý; thực hiện các trách nhiệm của Ban Quản lý trong trường hợp Ban quản lý đã không được thiết lập,
thực hiện 6.2.6 bảo hành công trình trên các căn hộ trong thời hạn bảo hành theo thông báo bằng văn bản của người thuê nhà theo quy định của pháp luật của Việt Nam và Tổng Internal Quy tắc này;
6.2.7 trả hình phạt và bồi thường thiệt hại cho người thuê khi vi phạm quy định trong đó các chủ nhà phải nộp tiền phạt và bồi thường theo quy định của Hiệp định này hoặc quyết định của cơ quan có thẩm quyền;
dự trữ vốn 6.2.8 trả 2% trong theo quy định của pháp luật đối với các vùng Private thuộc sở hữu của chủ nhà và chuyển tất cả dự trữ vốn thu được từ việc thuê nhà để các tài khoản ngân hàng và giao cho Ban Quản lý; và
6.2.9 Hướng dẫn, hỗ trợ các thuê ký hợp đồng dịch vụ với nước, thoát nước, viễn thông và nhà cung cấp truyền hình cáp.
ĐIỀU DEFAULT 7. THUÊ CỦA
7.1 Không làm phương hại đến quyền và nghĩa vụ khác được trao cho chủ thuê nhà theo Hiệp định này và pháp luật của Việt Nam , người thuê có trách nhiệm có trách nhiệm bồi thường cho chủ cho thuê tất cả các thiệt hại phát sinh từ việc vi phạm của người thuê căn hộ trong thời gian thực hiện Hợp đồng này theo quy định của pháp luật Việt Nam.
7.2 Không làm phương hại đến các quyền và nghĩa vụ về người cho thuê theo Hiệp định này và pháp luật của Việt Nam, nếu người thuê không thanh toán hoặc phải nộp đầy đủ Căn hộ cho thuê giá hoặc bất kỳ số lượng các khoản phải trả cho người cho thuê theo Hiệp định này vào ngày đến hạn, người thuê phải trả lãi trên số tiền quá hạn tính từ ngày hết hạn cho đến khi ngày nhận được số tiền quá hạn của các chủ nhà với tỷ lệ Rate Penalty.
