How does VIETNAM’s IP legal framework compare to INTERNATIONAL STANDARDS? Prior to Vietnam’s accession to the World Trade Organization (WTO) in 2007, the country issued many new laws and regulations to strengthen the protection and enforcement of IP rights, and to upgrade these laws to meet the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement). Generally speaking, Vietnam’s IP legislation is now relatively comprehensive, covering most aspects of protection of IP in accordance with international standards required by the TRIPS. Although a sounder legal framework is now in place, the enforcement mechanisms still need to be strengthened, fines must increase to truly become an effective deterrent, and awareness of counterfeits among Vietnamese consumers needs to be raised.

Làm thế nào để khuôn khổ pháp lý của VIỆT NAM IP so với TIÊU CHUẨN QUỐC TẾ? Trước khi gia nhập của Việt Nam với Tổ chức Thương mại Thế giới (WTO) vào năm 2007, cả nước đã ban hành nhiều luật và quy định để tăng cường bảo vệ và thực thi quyền SHTT, và nâng cấp các luật này để đáp ứng các Hiệp định về các khía cạnh thương mại liên quan đến sở hữu trí tuệ mới Quyền (Hiệp định TRIPS). Nói chung, luật pháp IP của Việt Nam hiện nay là tương đối toàn diện, bao gồm hầu hết các khía cạnh của bảo vệ IP phù hợp với tiêu chuẩn quốc tế theo yêu cầu của TRIPS. Mặc dù một khuôn khổ pháp lý vững chắc hơn tại là ở chỗ, các cơ chế thực thi vẫn còn cần phải được tăng cường, tiền phạt phải tăng để thực sự trở thành một biện pháp hiệu quả, và nhận thức của người tiêu dùng Việt giả trong số cần phải được nâng lên.
