In this section, I shall comment on two aspects of Epstein’s treatment of adverse possession, suggesting that his lack of clear focus on the varying role of the temporal element in the different theories of property results in some distortions. First, Epstein sees a tension between Lockean entitlement theory, which he refers to as ‘principle’, and what appears to be a form of rule-utilitarianism, which he refers to as ‘pragmatic’. With respect to this opposition of principle and pragmatics, I suggest that Epstein himself is in tension with regard to the extent of his commitment to Lockean entitle-ment or rule-utilitarianism as his primary normative theory. Second, Epstein ignores personality theory. This might mean that he finds it wholly implausible as an expla-natory/justificatory theory, and if so I differ with him. I think it sheds interesting light on some aspects of the problem of adverse possession.
