) The Contractor shall be responsible for the design and suitability for purpose of performance of any part of the Works under the Contract which either expressly or by implication leaves any question of design, specification or choice of materials, goods or workmanship to the Contractor or any of his sub-contractors or suppliers. The Contractor shall ensure that such works are fit for its purpose.

(4) The Contractor shall pre-plan the Works and, inter alia, check for discrepancy in or divergence between all the Contract Documents and/or any subsequent documents issued by the Project Manager prior to the executing the Works or any part thereof. When the Contractor finds any such discrepancy or divergence, he shall immediately give to the Project Manager a written notice specifying the same and the project Manager shall issue instruction in regard thereto. The Contractor shall ensure that such written notice shall reach the Project Manager not less than fourteen (14) day from the day on which it is necessary for him to receive the Project Manager’s instruction in regard thereto. Notwithstanding any checks carried out by the Project Manager, the Contractor shall be responsible for and (unless the Project Manager shall otherwise instruct, in which case the Contract Sum shall be adjusted accordingly) shall entirely at his own cost amend any errors arising from his failure or neglect to carry out checks and/or to notify the Project Manager of any discrepancy in or divergence between the Contract Documents and/or any subsequent documents issued. Any discrepancy or divergence shall not vitiate this Contract.

(5) Notwithstanding Clause 12(1), where there is discrepancy within the Contract Documents, the Project Manager shall decide between the discrepancy items and the Contractor shall be obliged to comply with the decision without additional cost to the Employer.
