Eligibility of BIDDER
a. BIDDER shall be eligible required as follows:
In case of independent BIDDER:
- Domestic BIDDER is to provide notarized copy of eligible certificate of business registration in accordance with Vietnamese Laws;
Foreign BIDDER is to provide notarized copy of eligible certificate of business registration in accordance with the law of BIDDER's country;
- BIDDER is an independent cost accounting entity;
- There is no decision by a competent authorities concluding that the BIDDER has an unhealthy financial status; BIDDER is not in bankrupt or insolvent status, and BIDDER is not in the process of dissolution.
b. In case of Consortium:
- Each Consortium Partner is to provide the documents and to meet the requirements mentioned in paragraph 1.3.a. above.
- Written Consortium Agreement between the consortium partners specifying responsibilities (joint and several) of each Consortium Partner in implementing the Bid, rights and scope of work and respective value of each Consortium Partner, including the Leading Consortium Partner and its responsibility, place and date of signing the Consortium Agreement, signatures and seals (if any) of Consortium Partners. If the Consortium Partner is authorized as the Leading Partner to sign the Proposal Letter, this effect shall be stated in the Consortium Agreement).

Điều kiện của THẦU
a. THẦU phải có đủ điều kiện yêu cầu như sau:
Trong trường hợp của THẦU độc lập:
- Nhà thầu trong nước là cung cấp bản sao có công chứng giấy chứng nhận đủ điều kiện đăng ký kinh doanh theo quy định của pháp luật Việt Nam;
THẦU nước ngoài là để cung cấp bản sao có công chứng giấy chứng nhận đủ điều kiện đăng ký kinh doanh theo quy định pháp luật của nước THẦU của;
- THẦU là đơn vị hạch toán kinh tế độc lập;
- Không có một quyết định của cơ quan có thẩm quyền kết luận rằng THẦU có tình hình tài chính không lành mạnh; THẦU không đang trong tình trạng phá sản hoặc vỡ nợ, và THẦU không phải là trong quá trình giải thể.
b. Trong trường hợp của Consortium:
- Mỗi Partner Consortium là cung cấp các tài liệu và để đáp ứng các yêu cầu nêu tại khoản 1.3.a. ở trên.
- Hiệp Consortium viết giữa các đối tác liên doanh xác định trách nhiệm (doanh và một số) của từng đối tác Consortium trong việc thực hiện đấu thầu, quyền và phạm vi công việc và giá trị tương ứng của mỗi đối tác Consortium, bao gồm cả các đối tác hàng đầu Consortium và trách nhiệm của mình, địa điểm và ngày ký Hiệp định Consortium, chữ ký, con dấu (nếu có) của Consortium Partners. Nếu Partner Consortium được phép như đối tác hàng đầu để ký văn Proposal, hiệu ứng này phải được nêu trong Hiệp định Consortium).
