a. The Parties are authorized to forward and process information made available to them within the scope of this contract within their group of companies.

b. Neither Smartdev nor any employee will use, in the performance of services hereunder, any materials in which Smartdev nor any third party claims Proprietary Interest without the prior written consent of peddler.

c. Smartdev guarantees that their employees will only work and utilize peddler’s confidential information whilst on Smartdev premises and with approved hardware property of Smartdev with fully working and updated antivirus programs and free of any virus, malware, spyware, Trojan, or other malicious software which may compromise the information held or accessible thorough the hardware.

d. Smartdev agrees that violation in any material respect of clause 8 or 9 should cause Peddler irreparable injury for which it would have no adequate remedy at law and, in the event of such violation, Peddler will be entitled preliminary and any other injunctive relief in addition to any other remedies to which Peddler may be entitled at law or in equity. The provisions of this clause will survive the term or termination of this Master service agreement for any reason.
