Health and safety of workersWorkers should be equipped/clothed for Safety working including crash helmet, boots and gloves during working in Site & Asphalt Mixing Plans, and reflective jacket when on road works. The Labour Safety Regulations should be posted on the wall of Contractors office (where it is easy to read). Bathroom, latrine will be constructed suitably, water for cooking and washing must be meet the ambient water quality standards of Vietnam both in Camps of Asphalt Mixing Plants and Construction Sites. Wastewater and rain drains shall be constructed and garbage shall be collected and disposed at locations duly authorized the concerned government agency.1.2. Public information and complaints resolutionPrior to construction works the Contractors with the WB-4 DEP and other concerned organizations shall conduct consultations with local affected persons to familiarize them with the Work to be done, the predicted impacts and mitigation to be used. Public information shall be conducted as an on-going process as required by the procedures established for the Work. The Periodic meetings between the Contractor, Project Manager, the Employer and other organizations shall be required as determined warranted to explain implementation plans, results of monitoring activities and actions taken in regard thereto, and/or other issues.Complaints and issues, and compensation for damages, spoilage or disturbance of properties and/or the health of project affected persons shall follow the procedures as established by the Project’s Policy Framework for Compensation, Resettlement and Rehabilitation of Project- Affected Persons, copies of which shall be made available to the Contractor.1.3. Unexploded ordnance (UXO)This is only a preservation project, construction activities are mainly carried out on the pre-existing and old road surface, which eliminate the possibility of encountering mines and bombs. However, in areas including the (new) material exploring area, the (new) anticipated material restoring area, provisional road leading to workers’ living area, and material restoring area (if any), the risk of encountering mines and bombs may be possible. In this given conditions, the contractors should carry out during public consultation, supervision and investigation at these areas to ensure that the risk of hidden UXO would be identified with the help of the Project Manager and Employer if necessary. In such cases, the Project Manager and Employer shall approve through signing a subcontract in ensuring the identification and removing of UXO. Only authorized military units (A Corporation of the Defense Ministry) are allowed to be responsible for this work.1.4. Environmental loss and compensationWhere roadside trees are lost as a result of construction activities, the Contractor will be required to replant trees as a ratio of one-to-one. Where trees cannot be replaced at the roadside due to a lack of roadside space, the Contractor shall consult with affected residents to determine an appropriate alternative planting location and schedule. The Contractor will be responsible for all works associated with tree planting including maintenance of the trees for a one-year period after planting.1.5. Protection of irrigation systems
To avoid potential adverse impacts to Irrigation Systems, the Contractor shall ensure irrigation channels diverted during the construction phase will be returned to their original status. Where this is not possible, or where channels are irreversibly altered, information and consultation will be held with Irrigation Management Company /landowners to ensure that an adequate redesign is undertaken to ensure that irrigation channels are returned as closely as possible to their former layout. The Contractor will undertake all necessary works to achieve this status, including provision of labor.
1.6. Protection of historic and cultural resources
To avoid potential adverse impacts to historic and cultural resources, the Contractor shall:
a) Protect sites of known antiquities, historic and cultural resources by the placement of suitable fencing and barriers.
b) Construction camps shall be located 500 meters away from cultural resources.
c) Adhere to accepted international practice and all applicable historic and cultural preservation requirements of the Government of Vietnam
