The two sides agreed together discuss economic contracting with the following terms.
Article I: CONTRACT CONTENT
Party A agrees to party B got construction work class: supplies and installation of systems of water supply and drainage according to categories in the enclosed price list.
ARTICLE II: EXECUTION:
Yen Phong industrial zone, Yen Phong district, BAC Ninh province.
ARTICLE III: THE PROGRESS AND THE WORK COMPLETED
-Start date: month…………..date..........., 2016
-Finish date: month………..date ......, 2016
Article IV: The VALUE And FORM Of PAYMENT:
-The value of the contract before tax is : 78,146,820 VND
-VAT 10% : 8,682,980 VND
-Total contract value : 86,829,800 VND
(In words: eighty six million eight hundred twenty-nine thousand eight hundred dollars.)
-Payment by cash or bank transfer on the company.
-Phase 1: Party A advance 40% of the value of the contract immediately after signing the contract to party B.
-Phase 2: after the party B make 80% of the volume of contract value, then party A payment of 30% of the contract value for the B side.
-Phase 3: payment soon after the work has completed the two sides conducted trials and settlement of contracts. Party A payment of 30% of the remaining contract value for the B side.
Article VI: RESPONSIBILITY Of The PARTIES
+ Respon sible A:
-Delivered premises for B constructing, construction design profile.
-Election of officers tracking techniques, monitoring the process of construction and repair to solve the problems arising in the process.
+ Responsible side B:
-Construction plans on the basis of technical design.
-Mobilization of manpower, machinery construction according to the approved plan, ensure the technical requirements.
-Compliance with the safety rules in the labour and ensure environmental hygiene.
Article VII: MATERIAL RESPONSIBILITY In The IMPLEMENTATION Of The CONTRACT:
-If the party performs incorrect according to the contract, not true with agreement on quality, project progress, payment deadlines, the offending party should bear the contractual penalty according to the provisions of the law.
-If the party B construction, repair does not guarantee the technical quality of the work to repair and rebuild.
-Breach of contract of the parties which cause physical damage to the other party, then the offending party should be responsible for the compensation of actual value.
Article VIII: The VALIDITY Of The CONTRACT
The contract established 2 a, each side keep 7 copies of the same legal value
The contract is valid from the date of signing.
