This document captures frequently asked questions (FAQs) regarding the U.S. Consumer Product Safety Improvement Act of 2008 (CPSIA). The Act, amended in 2011 and implemented by numerous CPSC rules, made significant changes to laws enforced by the Consumer Product Safety Commission (CPSC), including the Consumer Product Safety Act, Federal Hazardous Substances Act, and Federal Flammability Act, among others.As they relate to Nike and these FAQs, the most important changes are: (1) Requiring testing and certification of all finished non-children’s products subject to a CPSC standard, ban, rule, or regulation (General Certificates of Conformity); (2) Requiring testing and certification by independent, CPSC-accredited third-party labs of all finished children’s products subject to a CPSC standard, ban, rule, or regulation (Third-Party Certificates of Conformity); (3) Reducing allowable lead in paint/surface coatings on children’s products to 90 ppm; (4) Establishing a new standard for lead in substrates (total lead content); (5) Establishing a new ban on phthalates in children’s toys and child care articles; (6) Incorporating the ASTM F963-08 toy standard as a mandatory CPSC safety standard; (7) Allowing testing of components and materials to satisfy testing and certification requirements for finished products; and (8) Prescribing requirements for the content of General Certificates of Conformity and Third-Party Certificates of Conformity.These FAQs have been sorted into four categories, preceded by a summary table of requirements.
