SBC is the banking and financial services organizations in the world with many departments in other countries. When HSBC established in the market in Vietnam, HSBC need to make sure that every step in recruitment process is legal. The legal and regulatory elements and ethical element influence to HSBC's business activities. Therefore, according to Legal and Regulatory of local Government, Vietnamese Government, the foundation of HSBC must conform. Vietnam Government created labor laws with 17 chapters with 198 articles to protect the interests both of employees and employers. On the other hand, HSBC also involved in the European market such UK, so HSBC to know the laws of this country and abide by the laws of their country. Therefore, HSBC would like invest and keep the reputation and reach long term development, HSBC is subject to the laws of the market in which they are present.When HSBC worked in Vietnam, HSBC need to make sure that recruitment process is legal. The first step, HSBC needs to understand that Vietnamese has opportunity to working and contribute to HSBC. In addition, HSBC need to follow legal from Vietnamese Government to ensure that business activities are legal. According to Labor Law, Socialist Republic of Vietnam, 1994: “Everyone has the right to work, free choice of employment and occupation, vocational training and improve their careers, without discrimination of gender, ethnicity, social class, creed, religion or disability.” (Article 5). HSBC ensure focus on the ability of employees without the discrimination in respect of race, creed, social belonging, sex, and religion in recruitment process to create an equal and diverse working environment.Besides, HSBC has to obey the other contents in the labor law. For example: “An employer may be a business, an office, an organization or an individual (in the latter case he/she must be at least 18 years old). The employer hires, utilizes labor and pays for that labor.” (Article 6). HSBC hires people who are over 18 to work because the people who are under 18 years of age may not have sufficient ability and knowledge about the safety in working and person specifications. Besides, the recruitment of people who are over 18 specially is 23 years old because they graduated with certificates from university or college, they meet recruitment of HSBC and they can help HSBC guarantee the quality of labor with full knowledge, experience and ability to dedicate the company effectively. In addition, According to Labor Law, Socialist Republic of Vietnam, 1994: “ The minimum wage is based on the cost of living and must enable the employee who handles even the simplest work in normal working conditions to recuperate and also to accumulate for expanded reproduction. This minimum wage shall be used as the basis for the calculation of salaries for other types of labor.” (Article 56) and “The work day shall not exceed 8 hours or 48 hours per week. The employer is entitled to schedule the working hours daily or weekly but must notify the employees in advance (Article 68). Wages is the important thing for worker. HSBC want to attract to talent people who will working and contribute for HSBC, so HSBC should have reasonable salary and benefits for their employees. HSBC will bring a sufficient life with reasonable salary and benefits for staff to motivate them in working and ensure living standard of their staff. With reasonable salary, HSBC also factors contribute to develop social and people’s life. HSBC need to protect the health of workers and obey the law of working labor through the work day not to exceed 8 hours or 48 hours per week to improve the quality of HSBC's operation. In addition, HSBC can have services to take care of healthy of their staff.
