Document Establishing Bidder’s EligibilityThe documentary evidence of the Bidder’s eligibility to bid shall include:(i) The documentary evidence of the Bidder’s legally set up and having legally business registration to allow the Bidder doing business in the sector suitable to the required scope of supply. The person who signed the Bid Form should be a legislative representative of the Bidder. An eligible power of attorney shall be submitted by the Bidder if the Bid Form to be signed by any person other than a legislative representative. For foreign bidders, copy of the business registration and the power of attorney should be certified by notary office.(ii) Bid to be submitted by a consortium shall include the followings:A consortium agreement signed by all members of the consortium. The contents of this consortium agreement shall bind the joint and several liabilities of all members, clearly indicate the obligations of each member, authorize a member to be a lead member, authorize a person of the lead member to be a legally representative to sign all documents during the bid process as well as other exchanged documents between the Purchaser and the Bidder on behalf of all members of the consortium. The consortium agreement shall also indicate that the lead member shall act on behalf of all members of the consortium to work with other member and the Purchaser.Business registration of each member of the consortium and all other documentary evidence of the eligibility of each member of the consortium as required in ITB Clause 3.1 and 3.2.Lack of any required documents of any member of the consortium shall be deemed as a reason to determine the non-responsiveness of the consortium and its bid shall be rejected. Only consortium agreement specifically made for this package shall be acceptable. It shall be unacceptable of the consortium agreement made for all Projects.To make a consortium be eligible to bid, each member of the consortium should meet the minimum requirement as stated in the bidding documents specified for each portion of work to be carried out by such a member. If any of those requirements is not met, the consortium’s bid might be rejected.It is permitted that a Bidder or a member of a consortium may be a sub-contractor or manufacturer or supplier of other Bidders to bid for this package. In case a Corporation to be named as a Bidder, its units which are financial dependent shall not be allowed to submit Bids either by itself or as a partner in a consortium.In case of consortium: Two (02) members onlyOther document Establishing Bidder’s experience and capacity.The requirements for Bidder’s capacity shall be determined by consideration of the Bidder’s experience, similar contracts which have been carried out by the Bidder, annual income, various types of certificates, certificated of quality management granted to the Bidder. Therefore, the following criteria shall be indicated: Financially capable of participating in the bidding process:1. Financial statements acceptable to the Purchaser, for the last recent 3 years certified by an independent audit or competent authorities to demonstrate the current soundness of the Bidders financial position and its prospective long-term profitability.
2. Bidder’s aggregate net worth, The annual average turnover of the last three years, Current payment ratio of the last year specified at Section III.
3. Bidder is required to summarize his financial qualification in three (03) recent years by filling Form No. 12, Section IV.
Experience of Bidders to perform other Contracts for supply equipment:
4. Bidders are required to have at least number of years of experience in business field (specified at Section III) suitable for scope of works in this package according to Form No. 10 Section IV, accompanying documents evidence (if required).
5. A general experience record form is required to complete in accordance with the form ‘Bidder Information Form’ attached in Section IV “Sample Form” of the Bidding documents.
6. Bidders are required to have satisfactory experience in the execution of similar contracts as specified at Section III.
All above contracts are required to have certification of successful performance from the purchaser.
In case the Bidder had carried out a contract as member of a consortium, then the amount of works which the bidder assigned in consortium must have similar scale (including above scope of works and value of contract). In case of consortium, each member is required to evidence capability and experience met the requirements of Bidding documents for scope of works of each member carried out in JV.
7. The bidder should demonstrate in the bid the documents as evidence for his experience by using Form No. 8 & 9 Section IV that include list of contracts implemented or being implemented, Notification of contract awards, contract agreements, scope of supply, Purchaser’s certificates, etc.

Documents establishing Manufacturer’s experience in manufacturing the offered type of goods:
9. Documentary evidence to prove number of years of experience in manufacturing 500kV transformer, OLTC of the Manufacturers as specified at Section III.
10. Certificates from End-users certifying that the offered types of goods from the proposed manufacturers should have satisfactory commercial operation successfully: specified at Section III.
11. Valid quality assurance certificates: ISO-9001:2008 (or equivalent) of the proposed manufacturers as specified at Section III.
12. Other requirement for the manufacturers is specified at Section III.
Failure to furnish all above stated information/documents as well as the other requirements as stipulated in the bidding documents (after thorough clarification of the bid proposal) may result in the rejection of its bid as non-responsive.
The Bidder must not use foreign labors to perform the works which domestic labors have the ability to perform such works according to the requirements of the package, especially the common labors, labors without skill training. Foreign labors must meet the conditions as specified in the law on labor.
The documentary evidence of conformity of the goods and services to the bidding documents may be in the form of literature, drawings, and data, and shall consist of:
(a) Table with detailed lists of goods in accordance with requirements on the scope of supply provided in Section V.
(b) Time schedule in accordance with the requirements set out in Section VI.
(c) Complete catalogues and technical documents of goods offered. Catalogues may be in the Bidder’s own language provided that essential parts are translated into English.
(d) Technical documents such as standards of goods, function, specifications, warranty parameters of each type of goods (accompanied by drawings, if necessary), Original Manufacturer’s Authorization, according to Form No. 14, Chapter IV (In case the Bidder is not a manufacturer).
(e) Type test certificates and test report issued by independent testing laboratory having ISO/IEC 17025 certification for testing equipment. In case that a part of type tests shall be performed after signing the contract (tests to be carried out before mass manufacturing process) type test certificates for similar types shall be furnished for evaluation purpose only.
(f) Other requirements (if any).
Bid Security requirements:
• Form of Bid Security: in cash or bank guarantee.
+ the Bid Security shall be submitted in cash to the Finance and Accounting Department of PTC4 prior to deadline for bid submission, or
+ In case of a bank guarantee, the Bidder shall use the Form No. 13 included in Section IV issued by a reputable bank legally operated and located in Vietnam or a foreign bank branch which is established under the laws of Vietnam.
• Amount of Bid Security: 120.000 (U.S Dollars One hundred twenty thousand only) or VND 2.400.000.000 (Vietnam Dongs two billion and four hundred million only)
• Validity period of bid security: 150 days from the date with deadline for submission of Bids.
The Bid Security of unsuccessful Bidders shall be returned within 20 days from the date of the bidder selection result is approved.
Bid validity period: 120 days from the date with deadline for submission of bids.
Number of copies of Bid:
The Bidder shall prepare an original and four (04) copies of the bid.
The Bidders shall provide CD/DVDs using Microsoft Excel as a part of bid document including:
- the CD/DVD of Price Schedule (attachment in Financial Proposals bag)
- the CD/DVD of Technical specification data (attachment in Technical Proposals bag)
