It is legal for export processing enterprises to import from the local market several items to serve internal purposes (but not for sale in the EPZ), i.e. construction materials used to build structures in enterprises; stationery, food, and consumer goods serving the administration of their office apparatus and daily activities of their staff members and workers.
Export processing enterprises and their suppliers may choose whether or not to carry out the import and customs procedures for the aforementioned goods.
According to the provision at Clause 6 of Article 21 of the Decree No. 29/2008/ND-CP amended and supplemented by Clause 9 of Article 1 of the Decree No. 164/2013/ND-CP, export processing enterprises, which are granted Business License in goods purchase and sale and other activities directly related to goods purchase and sale in Viet Nam, must establish separate branches outside of the export processing enterprises and EPZ in order to conduct those activities.
Presently, such regulation is rather causing numerous complications for export processing enterprises since the inception of additional branches outside of the EPZ will undoubtedly result in extra costs of management, warehousing, personnel, etc. In addition, due to the fact that the EPZ is an industrial zone with defined geographical boundaries, entering and leaving the EPZ will also make it difficult for the management of the external branches.
Existing laws have yet to provide detailed regulations on the establishment of branches of export processing enterprises. Therefore, the current Law on Enterprise’s provisions on setting up branches of enterprises in general shall apply to export processing enterprises who wish to form branches outside of the EPZ. Furthermore, the relationship between export processing enterprises and their inland branches is prescribed to be export and import relationship. Export processing enterprises and branches engaging in the purchase and sale of goods must comply with the provisions on procedures and financial obligations applying to exports and imports.

Nó là hợp pháp để xuất khẩu chế biến các doanh nghiệp nhập khẩu từ thị trường địa phương một số mặt hàng để phục vụ mục đích nội bộ (nhưng không phải để bán trong KCX), tức là vật liệu xây dựng sử dụng để xây dựng các cấu trúc trong các doanh nghiệp; văn phòng phẩm, thực phẩm và hàng tiêu dùng phục vụ quản lý của bộ máy văn phòng và các hoạt động hàng ngày của nhân viên và công nhân của họ.Xuất khẩu các doanh nghiệp sản xuất và nhà cung cấp của họ có thể chọn hay không để thực hiện các thủ tục nhập khẩu và hải quan đối với hàng hóa nói trên. Theo quy định tại khoản 6 của điều 21 của nghị định 29/2008/NĐ-CP sửa đổi và bổ sung thêm khoản 9 của điều 1 của nghị định số 164/2013/ND-CP, các doanh nghiệp chế biến xuất khẩu, mà được cấp giấy phép kinh doanh hàng hoá mua bán và các hoạt động khác liên quan trực tiếp đến hàng hoá mua và bán tại Việt Nam, phải thành lập chi nhánh riêng biệt bên ngoài xuất khẩu chế biến các doanh nghiệp và KCX để tiến hành các hoạt động.Hiện nay, quy định thay vì gây ra nhiều biến chứng xuất khẩu chế biến các doanh nghiệp kể từ khi thành lập thêm chi nhánh bên ngoài KCX chắc chắn sẽ dẫn đến các chi phí phụ của quản lý, kho bãi, nhân sự, vv. Ngoài ra, do thực tế là KCX là một khu công nghiệp với xác định ranh giới địa lý, nhập và để lại KCX cũng sẽ làm cho nó khó khăn cho việc quản lý các chi nhánh bên ngoài.Pháp luật hiện hành vẫn chưa cung cấp quy định chi tiết về việc thành lập của chi nhánh của các doanh nghiệp chế xuất. Do đó, hiện pháp luật quy định của doanh nghiệp về việc thiết lập các chi nhánh của các doanh nghiệp nói chung sẽ áp dụng để xuất khẩu các doanh nghiệp chế biến những người muốn để hình thức chi nhánh bên ngoài KCX. Hơn nữa, mối quan hệ giữa xuất khẩu các doanh nghiệp sản xuất và chi nhánh nội địa của họ được quy định để là xuất khẩu, nhập khẩu các mối quan hệ. Chế các doanh nghiệp và các chi nhánh tham gia vào mua và bán hàng hóa xuất phải tuân thủ các quy định về thủ tục và nghĩa vụ tài chính áp dụng cho xuất khẩu và nhập khẩu.
