Step 5: Complete the tax procedures with the Tax authorities
1. Receive the tax decision numbers for the final tax settlement and close the figure.
FADACO commits to carry out all methods deemed as necessary to ensure the Company’s interests inclusive of preparing appeal letter(s), persuading the competent authorities and other methods (if necessary);

4. Service fee and Term of Payment
Service fee shall be charge at VND in detail:
- • All in cost of this contract (included but not limit at professional services and other cost) for final tax settlement (excluded VAT): 410,000,000 VND (lump sum cost).
(Four hundred and ten millions Vietnamdong only)
CAPITALAND - HOANG THANH COMPANY LIMITED limited pays in advance to FADACO 20% of the contract’s value after signing this commitment.
When Hanoi tax team finishes field work in CAPITALAND - HOANG THANH COMPANY LIMITED and has the minutes for final tax settlement, CAPITAL LAND COMPANY LIMITED pays 40% of the contract’s value.
The rest will be paid after CAPITALAND - HOANG THANH COMPANY LIMITED gets the approval from the Ha Noi Department of Taxation as the above mention.

5. Commitment
The two parties commit to implement all the articles as set forth herein. Should there be any difficulties during the implementation process, both parties should be kept informed on a timely basis in order to work out a possible solution.
Any obstacles or disputes arising from or in the performance of this contract shall be firstly settled through direct negotiations. Failing which, the obstacles or disputes shall be settled at the Economic Court of the signing location.
