All these would have been an obscure exercise in internal politics of an internationalorganisation but for the fact that the European Community expressly124and the European Union in fact125 have indeed international personalityand may – indeed, regularly – act in the international scene concludinginternational agreements with third parties. These treaties take typically theform of a ‘mixed agreement’, defined as: “an agreement to which one or more of the Communities and the memberStates are, or may become, parties, and which contains provisions some elementsof which fall within Community competence, and some of which fallwithin the competence of the member States”1
