g) fails to pay any sum due to the Purchaser hereunder (being a sum which is in excess of the amount that the Purchaser at the time the relevant payment becomes due and payable is able to drawdown under the Bonds held by the Purchaser at such time, and which is not reasonably in dispute) and such failure is continuing for forty two (42) days following notice of failure to the Contractor;
