Cost and paid free out 1 safe anchorage and/or 1 safe port, 1 safe berth at Cai Lan port and/or Hon Cai port
9, Payment
In US dollars by irrevocable negotiable 120 days after sigh usance ( at 2,2% P.A) irrovocable letter of credit issued by one of the first class bank in Viet Nam subject to seller’s acceptance
Failure to do so, seller has right to terminate this contract.
Letter of credit (L/c) to allow for
A. Validity of the L/c at the counter of negotiating bank at seller’s option at least for 30 days after the last day of shipment period
B. L/s to be available with any bank for negotiation
C. Third party shipping documents (except invoice) allowed
D. Documents presented not later than 30 days after date of B/L but within the credit validity allowed
E. All documents dated later or ealier than date of B/L acceptable
F. All document accept invoice not showing full description of cargo acceptable
G. 10% more or 10% less in quantity and credit amount allowed
H. Tupo errors and spelling mistakes acceptable except commodity names, specifications, quantity, unit price and total price
I. Invoice showing deduction of quality allowances and/or delay shipment allowances accaeptable
J. Partial shipmant allowed
K. Documents showing quantity in metric tons and/or pounds acceptable
L. Any certificates issued in local official language but with english translation by the seller and/or third party acceptable
M. Inconsistent shipper’s name or exporter or consignor on document’s acceptable
N. Charpter party bills of lading acceptable
O. Result figure of aflatoxin on quanlitu certificate: ‘’negative’’ or ‘’ below detection limit’’ is acceptable
P. Result figure of specification on quanlity of certificate: decimal round off is acceptable
Q. ‘’Vessel’’ or ‘’Actual vessel name’’ on required shipping documents are both acceptable
R. Shipment before L/c issuing date is allowed
S. An extension of the latest shipment date and automatic extension of L/c validity and presentation period of documents according to number of days delayed are allowed up to a maximun of 30 days in the following circumstances
T. Delay in shipment due to force majeure event as described in clause 19 of the gafta no 100 agreement to be presented by beneficiary in a letter of statement
